Returns and Complaints Policy – TOOLSA.eu
(This section applies exclusively to Customers who are Consumers within the meaning of Section II, point 2 of the Online Store Terms and Conditions of Toolsa Europe Remigiusz Prędki https://www.toolsa.eu//en/info/store-terms-and-conditions). Businesses purchasing goods with a VAT invoice are not entitled to return purchased equipment under applicable law.
- A Consumer who has concluded a distance contract or a contract concluded outside the Seller’s premises may withdraw from the contract without stating any reason and without incurring costs, except for the costs specified in Article 33, Article 34(2), and Article 35 of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2020, item 287, as amended), by submitting a relevant declaration in any form within 14 days from the date of delivery of the ordered goods. To meet this deadline, it is sufficient to send the declaration before its expiry to the following address: Toolsa Europe Remigiusz Prędki, ul. The withdrawal period begins:
- for a contract under which the Seller delivers the goods and is obliged to transfer ownership – from the moment the Consumer or a third party designated by the Consumer (other than the carrier) takes possession of the goods;
- for a contract covering multiple goods delivered separately, in batches, or in parts – from the moment the last item, batch, or part is taken into possession;
- for other contracts – from the date of conclusion of the contract.
- In the event of withdrawal from a contract concluded outside the Seller’s premises or at a distance, the contract shall be deemed null and void. Any performances exchanged by the parties shall be returned unchanged. The return should be made immediately, no later than within 14 days. The purchased goods must be returned to the following address: Toolsa Europe Remigiusz Prędki, ul. Inwalidzka 20, 41-506 Chorzów.
- The Consumer is liable for any diminished value of the goods resulting from use other than that necessary to establish the nature, characteristics, and functioning of the goods.
- If the Consumer selected a delivery method other than the least expensive standard delivery offered by the Seller when placing the order, the Seller is not obliged to reimburse the additional costs incurred by the Consumer.
- The direct cost of returning the goods as a result of exercising the right of withdrawal shall be borne by the Consumer. The Consumer is obliged to return the goods no later than 14 days from the date on which the Seller was informed of the withdrawal from the contract. To meet the deadline, it is sufficient to send the goods back before its expiry.
- In the event of withdrawal by the Consumer, the Seller shall refund the order amount within 14 days from the date of receiving the returned goods or from the date the Consumer provides proof of return shipment, whichever occurs first. The refund will be made to the bank account indicated by the Consumer. The Seller shall make the refund using the same payment method used by the Consumer, unless the Consumer has expressly agreed to another refund method that does not involve any additional costs for the Consumer.

- Proof of purchase (e.g. receipt or invoice) should be enclosed with the returned goods.

The right to withdraw from a contract concluded outside the Seller’s premises or at a distance does not apply in the cases described in Article 38
of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2020, item 287, as amended), including in relation to:
- goods manufactured according to the Consumer’s specifications or clearly personalized;
- goods which, after delivery, due to their nature, are inseparably combined with other goods;
- sealed data carriers if the packaging has been opened after delivery.
- Detailed rules regarding the exercise of the right of withdrawal from a distance contract are set out in the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2020, item 287, as amended).
